By registering for a tour with Camino Quest LLC, you are agreeing to the terms outlined in this Participant Agreement and Waiver. This document provides important information about your travel responsibilities and the risks associated with your journey. We encourage you to read this carefully to fully understand the conditions of your tour participation with us.

1. Voluntary Participation and Assumption of Inherent Risks

I acknowledge that I have voluntarily applied to participate in this pilgrimage/tour. I understand that this tour involves significant physical activity, including walking long distances over uneven terrain, exposure to varying weather conditions, and travel to locations where medical facilities may be remote, inaccessible, or below the standards of my home country.

I voluntarily accept and assume full responsibility for all risks, known and unknown, associated with this tour. These risks include, but are not limited to:

• Physical Safety: Slips, falls, traffic accidents, physical exertion, foot injuries (including blisters, tendonitis, and joint stress), and consumption of food or water that may cause illness.

• Health & Medical: Exposure to contagious diseases, lack of immediate medical attention, and the unavailability of specific medications.

• Logistical & Environmental: Civil unrest, acts of terrorism, strikes, natural disasters (Acts of God), defects in vehicles, accommodation conditions that may differ from home standards (e.g., shared bathrooms, lack of air conditioning), and itinerary changes caused by third-party providers.

2. Release of Liability and Indemnification

Release of Liability: To the fullest extent permitted by law, I hereby release, waive, and discharge Camino Quest LLC, its owners, employees, and agents from any and all liability, claims, demands, or causes of action whatsoever arising out of any damage, loss, injury, or death resulting from the inherent risks of the tour or from the ordinary negligence of Camino Quest LLC or its staff, including errors in judgment or supervision.

Indemnification: I agree to indemnify and hold harmless Camino Quest LLC for any costs, expenses, legal fees, or liabilities incurred as a result of my own conduct, actions, or negligence during the tour (e.g., damage to lodging property or injury to third parties).

3. Fitness to Travel and Group Integrity

I warrant that I am in good physical and mental health and am capable of completing the essential functions of this pilgrimage, which includes walking between 14km (8.5 mi) to 29km (18 mi) daily over challenging terrain, and navigating obstacles without assistance. I agree to fully disclose any medical conditions or required accommodations to Camino Quest LLC.

I acknowledge that Camino Quest LLC staff are not medical professionals or personal aides and cannot provide specialized assistance, medication, or personal mobility support. I understand that the Company reserves the sole right to remove me from the tour, without refund, if my undisclosed condition, fitness level, or behavior impedes the group's progress or creates a safety risk. I accept full financial responsibility for any resulting costs, including early departure and repatriation.

4. Itinerary, Transportation, and Illness

• Itinerary Flexibility: I am aware that my itinerary may be impacted by unforeseen circumstances (weather, route closures, flight cancellations). Changes are made to ensure the safety and best possible experience for all participants.

• Group Transportation: If I miss scheduled group transportation, I am responsible for the cost of my own transportation to rejoin the group. No refunds will be issued for missed transfers.

• Illness Risks: I recognize the risk of contracting an illness before, during, or after the trip. Consequences such as denied boarding, quarantine, and additional costs are my responsibility.

5. Cancellation & Refund Policy

• Standard Cancellation by Participant:

• 60+ days before start date: $350 cancellation fee per person. (Refunds are net of third-party processing fees).

• 59-22 days before start date: 50% cancellation fee per person. (Refunds are net of third-party processing fees).

• 21 days or less: No refund is possible.

• Cancellation by Camino Quest LLC (Operational):

• If we cancel due to under-enrollment or operational inability to run the trip, you will receive a full refund. (Refunds are net of third-party processing fees).

• Force Majeure (Events Beyond Our Control):

• If Camino Quest LLC is prevented from performing its obligations due to Acts of God, war, government restrictions, pandemics, strikes, or other events beyond our control ("Force Majeure"), we will recover as much of the tour costs as possible from our vendors / third party providers. You will receive a refund of these recovered funds, less a reasonable administrative fee. Any unrecoverable funds may be issued as a future travel credit rather than a cash refund.

6. Governing Law and Venue

This agreement shall be governed by and construed in accordance with the laws of the State of Oregon. Any legal dispute arising out of or in connection with this tour must be filed exclusively in the courts of Clackamas County, Oregon.

7. TRAVEL INSURANCE WAIVER AND DECLINATION

Acknowledgment of Risk: Camino Quest LLC strongly recommends that all travelers purchase comprehensive travel insurance. I acknowledge that I have been advised to purchase insurance covering:

• Trip Cancellation/Interruption

• Emergency Medical Expenses

• Emergency Medical Evacuation (Repatriation)

• Baggage Loss and Travel Delay

Decision to Decline: By signing below, I confirm that:

1. I have been offered the opportunity to purchase travel insurance (see travel insurance brokers here); AND

2. I am voluntarily choosing to DECLINE this coverage OR I am relying on a third-party policy and accept full responsibility for its adequacy.

Assumption of Financial Responsibility: I understand that by declining this insurance, I am assuming 100% financial responsibility for any and all costs incurred due to trip cancellation, medical emergencies, evacuation, or travel delays. I release Camino Quest LLC from any duty to provide refunds or assistance with costs that would have otherwise been covered by standard travel insurance.

8. Final Agreement

I understand that this waiver does not list all risks involved in traveling. I assume all risks, listed or not, and hereby fully release and forever discharge Camino Quest LLC, its employees, contractors, and agents from all liability in connection with my participation on the tour.
